These Terms of Use (“Terms”) govern your access to and use of nexustelematics.com (the “Site”), operated by Nexus Telematics (“Nexus,” “we,” “us”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms cover the marketing website only. Use of the Nexus platform, hardware, and services is governed by separate service agreements provided at purchase — if there is a conflict between these Terms and a signed service agreement, the service agreement wins.

1. Use of the Site

You may use the Site for lawful purposes related to evaluating and using our products. You agree not to: (a) interfere with the Site's operation or security; (b) attempt to gain unauthorized access to any systems or data; (c) scrape, harvest, or bulk-download Site content or data except as permitted by our robots.txt; (d) submit false or misleading information through our forms; or (e) use the Site to transmit malware or unsolicited commercial messages.

2. Content and intellectual property

The Site and its content — text, graphics, logos, product names (including Nexus, Nexus Vision, VT-series), images, software, and design — are owned by Nexus or its licensors and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive license to view and use the Site for its intended purpose. No other rights are granted. Third-party trademarks referenced on the Site (including competitor names on comparison pages) belong to their respective owners; references are for identification and comparison only and do not imply endorsement.

3. Pricing and product information

We publish plan pricing on the Site because we think you deserve to see it. Published prices are “from” rates per vehicle per month, exclude applicable taxes, and depend on fleet size and hardware configuration; the binding price for your fleet is the one in your written quote and service agreement. Product features and specifications may change as the platform improves. Comparison-page statements about other vendors reflect their public information as of the date indicated; we correct errors promptly when notified.

Nothing on the Site is a representation that our products satisfy every regulatory requirement applicable to your specific operation. ELD and Hours of Service features are provided through an FMCSA-registered ELD solution integrated into our platform; whether and how those requirements apply to your fleet, and your compliance with them, remain your responsibility.

4. Forms and communications

When you submit a form, you represent that the information is accurate and that you are authorized to provide it. Consent to marketing communications is optional, is captured separately on the form, and can be withdrawn at any time via the unsubscribe link or by contacting us. Our use of your information is described in the Privacy Policy.

5. Third-party links

The Site may link to third-party websites (for example, app stores or review platforms). We do not control them and are not responsible for their content or privacy practices.

6. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CONTENT ON THE SITE — INCLUDING BLOG ARTICLES, CALCULATORS, AND SAVINGS ESTIMATES — IS GENERAL INFORMATION, NOT LEGAL, TAX, INSURANCE, OR COMPLIANCE ADVICE, AND ACTUAL RESULTS VARY BY FLEET. HARDWARE WARRANTY TERMS ARE DEFINED IN THE APPLICABLE SERVICE AGREEMENT, NOT ON THIS SITE.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXUS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY ARISING FROM USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

8. Indemnification

You agree to indemnify and hold Nexus harmless from claims arising out of your misuse of the Site or violation of these Terms.

9. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any dispute arising from these Terms or the Site will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

10. Changes and termination

We may update these Terms by posting a revised version with an updated date; continued use of the Site after changes take effect constitutes acceptance. We may suspend or terminate Site access for conduct that violates these Terms.
